These Terms of Use ("Terms") are a binding agreement between you and the operator of Charge & Explore ("Charge & Explore," "we," "us"). By downloading, accessing, or using the Charge & Explore mobile app or website (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Independent product. Charge & Explore is an independent product and is not affiliated with, endorsed by, sponsored by, or connected to Tesla, Inc. "Tesla," "Supercharger," and related names and logos are trademarks of their respective owners and are used, if at all, only nominatively to describe compatibility. We are also not affiliated with any charging network, venue, restaurant, or other business that may be shown in the Service.

1. Eligibility

You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect their data.

2. The Service

Charge & Explore suggests EV charging stops and nearby activities and displays charging-related information. Charging-station locations, availability, connector types, pricing, and charge-time and range figures come from third-party sources and/or are computed estimates. They may be inaccurate, incomplete, delayed, or out of date. Always independently verify station availability, connector compatibility, pricing, your vehicle's actual range, and road/traffic conditions before relying on any information in the Service.

3. Safety & assumption of risk

Do not interact with the service while driving or operating a vehicle. Pull over and park first. The service is a planning and information aid only — it is not a real-time navigation, safety, or emergency system, and must not be relied upon in any situation where inaccurate, unavailable, or delayed information could lead to injury, being stranded, property damage, or other loss.

You are solely responsible for your driving, your route, your charging decisions, and your vehicle. You assume all risks arising from use of the service and from your reliance on any information it provides. In an emergency, call your local emergency number.

4. Your account and vehicle connection

Connecting a Tesla or other vehicle account is optional and governed by our Privacy Policy. Any such connection is read-only: the Service requests vehicle data (and, optionally, location) but requests no vehicle-command or charging-command permissions and cannot control your vehicle. You must comply with the applicable terms of any account you connect (including Tesla's). You are responsible for the security of your own devices, credentials, and accounts, and you may disconnect and request deletion at any time.

5. Demo Mode

The Service offers a "Demo Mode" that loads a synthetic, sample vehicle and sample telemetry for demonstration and review purposes only. Demo Mode data (e.g., a sample "Demo Model 3," sample charge level, and sample stations) is fictional and illustrative, does not reflect any real vehicle, and must not be relied upon for any real-world decision.

6. Third-party data, services, and locations

The Service incorporates data and links from third parties (charging-network and mapping/data providers) and may surface third-party venues, businesses, and activities. We do not control, endorse, guarantee, or assume responsibility for any third-party data, website, product, service, business, or location. Your dealings with, and any visit to, any third party are solely between you and that third party and at your own risk.

7. Acceptable use

Do not: attempt to access other users' data; probe, scan, overload, or disrupt the Service or its infrastructure; scrape, harvest, or bulk-export data from the Service; reverse engineer the Service except where that restriction is prohibited by law; use the Service unlawfully or in violation of any connected provider's terms (including Tesla's); or use the Service to build a competing dataset.

8. Intellectual property

The Service, including its software, design, text, and branding (excluding third-party marks), is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

9. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty of accuracy, availability, reliability, or uninterrupted or error-free operation. We do not warrant that any station, route, price, estimate, or activity information is accurate, current, or available. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Charge & Explore, its operator, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, range, time, or for personal injury, property damage, being stranded, or missed charging — arising out of or relating to the service or your use of or inability to use it, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us for the service in the twelve (12) months before the claim, or twenty U.S. dollars ($20).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, for gross negligence, willful misconduct, or death or personal injury caused by our negligence where such a limitation is not permitted).

11. Indemnification

You agree to indemnify, defend, and hold harmless Charge & Explore and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Subject to Section 13, the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction, and you consent to venue there.

13. Dispute resolution; arbitration; class-action waiver

Please read this section carefully. Except for claims that may be brought in small-claims court, and except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, and you and we waive any right to a jury trial and to participate in a class, consolidated, or representative action. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court under Section 12. Where mandatory local consumer law gives you a non-waivable right to bring a claim in your home courts, this section does not remove that right.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive (including 6–13 and 15) survive termination.

15. Changes

We may update these Terms; material changes will be posted on this page with a new "last updated" date and, where required, in-app notice. Continued use after changes means you accept the updated Terms.
